Fraud Gallery

INFORMATION

All the products features in this “Gallery” are frauds of the Appellation of Origin Porto. By attempting to have a similar appearance to that usually associated with Port wine bottles, and presented on the shelves next to the genuine article, these products aim to confuse the customer into erroneously assume their origin and quality.

Why are they not Port Wine?

- Only fortified wines produced in the Douro Demarcated Region, that conform to the physical-chemical and organoleptical characteristics laid out by the IVDP, can be called Port wine;
- Only those who are registered with the IVDP and have the capacity to do so, can produce and sell Port wine;
- The labels must be approved by the IVDP;
- The bottle must bear the seal of guarantee.

Be careful:

- Verify if the bottle contains the appellation of origin Port (or its translations);
- Verify if the bottle contains the guarantee seal issued by IVDP (this seal has security elements);
- Verify it the label contains the indication “Produced in Portugal”.
- Note: all of these elements are compulsory and, therefore, must be on the labelling of the Port wine bottles.

Protecting place names – truth on labelling:

We must take into account that not all countries in the world recognize or protect appellations of origin as an intellectual property right. Port is an appellation of origin recognized and protected in Portugal, in the European Union and in the countries that are members of the Madrid Agreement Concerning the Repression of False or Deceptive Indications of Source or of the Lisbon Agreement for the Protection of the Appellations of Origin and their International Registration (administered by the World Intellectual Property organization – WIPO). The recognition and protection of the appellation of origin Port may also derive from bilateral agreements celebrated by Portugal and the European Union, as well as from the Word Trade Organization (WTO) Agreement on the Trade Related Aspects of Intellectual Property Rights (TRIPS), taking into account, however, of the several exceptions established by this agreement.
